By accessing the Site or placing an order, you agree to be bound by these Terms as well as our Privacy Policy, Refund & Returns Policy, and Shipping Information.

If you do not agree to these Terms, please do not use the Site.

2. Eligibility & Account

• You must be at least 18 years old or the legal age of majority in your jurisdiction to make a purchase.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• We may refuse service, terminate accounts, or cancel orders at our sole discretion for any lawful reason.

3. Products & Authenticity

• All products listed are described and photographed to the best of our ability. Product colors may vary slightly due to lighting or device displays.
• We follow a multi‑step verification process to ensure authenticity of BAPE apparel and accessories. See our FAQ and product descriptions for details.
• Some items may be limited releases or rare sizes; availability can change quickly and is not guaranteed until your order is confirmed.

4. Pricing, Taxes & Currency

• Prices are shown in USD unless otherwise stated and may change without prior notice.
• Applicable taxes, duties, and fees are calculated at checkout or upon delivery depending on your location.
• In the event of a pricing error, we may contact you to reconfirm your order or cancel it with a full refund.

5. Orders & Payments

• Orders are offers to purchase and are subject to acceptance by us. You will receive an order confirmation email once accepted.
• We accept major payment methods displayed at checkout (e.g., Visa, MasterCard, PayPal). You authorize us to charge your selected payment method for the total order amount.
• If a payment cannot be processed, we may cancel the order.

6. Shipping & Delivery

• Delivery estimates are not guarantees; delays can occur due to carrier or customs.
• You are responsible for providing a complete and accurate shipping address. Undeliverable packages may incur additional fees.

7. Returns & Refunds

• We accept returns subject to the conditions in our Refund & Returns Policy. Items must be in original condition with tags attached.
• Upon receipt, we will inspect the item for authenticity and condition before processing a refund or exchange.
• Original shipping fees may be non‑refundable unless otherwise stated.

8. Cancellations & Changes

• Order changes or cancellations can be requested prior to shipment by contacting [email protected]. We cannot guarantee that changes can be made once processing has begun.
• If an order is canceled after payment, refunds will be issued to the original payment method.

9. Risk of Loss & Title

Risk of loss passes to you upon delivery to the shipping address provided or upon pickup by the carrier if you arrange your own shipping. Title passes upon full payment and shipment.

10. Site Content & Intellectual Property

• All content on the Site, including text, images, graphics, logos, and design elements, is owned by or licensed to Bayer04Fans and is protected by intellectual property laws.
• You may not copy, reproduce, distribute, or create derivative works from the Site content without our written consent.
• Trademarks and brand names (including A BATHING APE and BAPE) remain the property of their respective owners and are used for identification and descriptive purposes.

• Do not use the Site for unlawful, harmful, fraudulent, or infringing activities.
• Do not attempt to disrupt or interfere with the Site’s security, integrity, or performance.
• Do not use bots or scraping tools without our prior written consent.

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any disputes not subject to arbitration as set forth below.

17. Dispute Resolution

• Good Faith Resolution: Contact us first at [email protected] to attempt to resolve any issue informally within 30 days.
• Arbitration: Except where prohibited by law, disputes shall be resolved by binding arbitration on an individual basis. Class actions are not permitted.
• Small Claims: Either party may bring qualifying claims in small claims court in Los Angeles County, CA.

18. Changes to Terms

We may update these Terms from time to time. Changes are effective when posted on this page with an updated “Effective date.” Your continued use of the Site constitutes acceptance of the revised Terms.
